Introduction to the Terms of Use Agreement:

1. (The Store) This term refers to the Breath Store, and this definition includes all forms of the Breath Store on the Internet, whether it is an electronic application or a page on any social networking platform.
2. (User) This term refers to any consumer who purchases a product or service from the store through its online platform.
3. (The Agreement) This term refers to the terms and conditions of this Agreement which govern and regulate the relationship between the parties to this Agreement.

Article Two - User's Legal Capacity:
1. The user acknowledges that he has the legal capacity, according to Sharia and regulations, to deal with the store, or that he is at least eighteen years old.
2. The user agrees that if he violates this article, he shall bear the consequences of this violation before third parties.

Article Three - Nature of Breath Store's Obligation:
1. Breath Store’s commitment to consumers or users is to provide (the service or product).
2. Breath Store may provide other services such as after-sales services or other related services, depending on the nature and type of (service or product) required by the user.

Article Four - Guidelines for Using the Breath Store:
1. The user commits to using the Breath Store's electronic platform in accordance with public morals and regulations in force in the Kingdom of Saudi Arabia.
2. When purchasing a service or product from Breath Store, the user undertakes not to use this service or product in a manner that violates public morals and the regulations in force in the Kingdom of Saudi Arabia.

Article Five - Accounts and Registration Obligations:
By applying for membership in Breath Store as a user, you are obligated to disclose information for use when accessing Breath Store services. By doing so, you agree to:
1. Breath Store is responsible for maintaining the confidentiality of your account information and you agree to immediately notify Breath Store of any unauthorized use of your Breath Store account information or any other breach of your confidential information.
2. Under no circumstances will Breath Store be liable for any loss that may be incurred by you, directly or indirectly, morally or materially, as a result of the disclosure of account information.
3. You must commit to using your Breath Store account or membership yourself, as you are fully responsible for it. If someone else uses it, you bear the consequences of losses or misuse, since you have authorized them to use the store in your name and for your account.
4. You must commit, when using Breath Store, to using it with all seriousness and credibility.
5. You agree to disclose true, correct, up-to-date, complete and legal information about yourself as required during registration with Breath Store and to update your data if it changes in reality or if the need arises.
6. Breath Store is committed to handling your personal information and contact details with complete confidentiality.
7. If Breath Store finds that you have disclosed untrue, incorrect, outdated, incomplete, illegal, or unlawful information that violates the Terms of Use Agreement, Breath Store has the right to suspend, freeze, or cancel your membership and account on the platform without prejudice to Breath Store’s other rights and legitimate means of recovering its rights and protecting other users.
8. In the event of non-compliance with any of the above, Breath Store management has the right to suspend or cancel your store or membership or block you from accessing Breath Store services again.

Article Six - Electronic Communications and Official Means of Communication:
1. The parties to this agreement agree that communication will be via email, WhatsApp registered on the platform, administrative WhatsApp after coordination with the official WhatsApp, phone number, or via social media platforms.
2. The user agrees that all data and communications provided electronically are equivalent to their written counterparts and constitute a valid and independent argument in meeting regulatory and legal requirements.
3. The user agrees to be contacted and notified of any provisions relating to this agreement or to dealings with him through the Breath Store management broadcasting general messages that are sent to all users or to specific users of the Breath Store.

Article Seven - Amendments to the User Agreement and Fees:
1. Breath Store may notify you of any amendment to this agreement in accordance with the official communication channels under this agreement.
2. In case of objection to any amendment to the Terms of Use, Breath Store hopes that you will stop using its services, as your access to your account in Breath Store or your use of Breath Store is considered your acceptance of the amendments and full and complete agreement without ignorance. Breath Store accepts discussion of any suggestion regarding these terms.
3. All fees are calculated in Saudi Riyals, and the user must pay all fees due on the platform, in addition to any other expenses added by Breath Store, provided that payment is made through the approved, specified, and available methods through Breath Store.
4. Breath Store may charge some users fees depending on the offers, products or services they request, or on the fees or taxes imposed by the state on the nature of the product or service.
5. Breath Store reserves the right to add, increase, decrease, or deduct any fees or expenses under the terms and conditions of the User Agreement from any user, regardless of the reason for their registration.

Article Eight – Payment and Settlement Services for Breath Store:
1. Breath Store, through its partners, provides a payment and settlement system. This can be done entirely online through the payment options available on Breath Store or through any payment method that Breath Store provides from time to time.
2. Breath Store is committed to setting the price of the service or product it offers in its store according to the accepted market value.
3. Breath Store is committed to providing invoices for all amounts and profits generated in its store and is committed to giving the user an invoice for their purchase of a service or product from Breath Store.
4. Breath Store is committed to providing the accounting specifications commonly accepted in its online store in accordance with the provisions of this agreement and in light of the legal, economic, commercial and regulatory interests in this arrangement.

Article Nine - Your personal information and transaction details:
1. The user acknowledges that he grants Breath Store an unlimited, worldwide, perpetual, irrevocable, royalty-free, and transferable right to use any personal or other information or materials that he or she has provided or made available to the Breath platform or announced on the platform through his or her joining or use of it, through the forms designated for communication and registration or through any email or any of the communication channels available on the platform, for the purpose of achieving any of the interests that the platform deems appropriate.
2. The provisions regarding the confidentiality of consumer information are subject to the rules of the Breath Store's "Privacy and Confidentiality Policy" and to the provisions of this agreement relating to confidentiality.

Article Ten – Intellectual Property:
1. The intellectual property rights of Breath Store are wholly owned by Breath Store, whether or not they were owned by them before the establishment of this platform.
Electronic or after its establishment.
2. The user or consumer respects the intellectual property rights of Breath Store, which include Breath Store itself and the words, logos and other symbols belonging to Breath Store or displayed on Breath Store, as Breath Store and every right belonging to Breath Store are fully intellectual property rights owned by Breath Store.

Article Eleven - Breath Store's Liability:
1. Breath Store is committed to conducting its business through this electronic platform in a regular manner and in accordance with the regulations in force in the Kingdom of Saudi Arabia and in accordance with the provisions of this agreement.
2. Breath Store does not accept any claims arising from errors or negligence, whether caused directly, indirectly, incidentally, by the user, or by a third party such as shipping companies.
3. Breath Store, its employees, owners, and representatives undertake that the (product or service) is sound, legitimate, and authorized in accordance with the laws and regulations of the Kingdom of Saudi Arabia and is used for legitimate purposes.

Article Twelve – Confidentiality of Information:
1. Breath Store adopts (tangible, organizational and technical) standards to protect users and prevent unauthorized access to and storage of users’ personal information.
2. As a user, you acknowledge that the internet is not a completely secure medium and the confidentiality of your personal information cannot be 100% guaranteed through Breath Store.
3. Breath has no control over the actions of any third party or other third parties, such as other web pages linked to the platform or third parties claiming to represent you and others.
4. You acknowledge and agree that Breath Store may use the information you have provided to provide you with services at Breath Store and to send you marketing messages, and that the privacy policy at Breath Store governs the collection, processing, use and transfer of your personal identity information and is subject to the rules of confidentiality of information in Breath Store’s “Privacy and Confidentiality Policy”.

Article Thirteen - Restriction of Access or Membership:
Breath Store may suspend or terminate a user's membership or restrict a user's access to the platform's services at any time, without notice, for any reason, and without limitation.

Article Fourteen - Applicable Law or Regulation:
This User Agreement is governed by and construed in accordance with the laws, regulations and legislation in force in the Kingdom of Saudi Arabia, and is subject in full and completely to the regulations in force with the authorities in the Kingdom of Saudi Arabia.

Article Fifteen - General Provisions:
- In the event that any article or clause contained in this User Agreement is cancelled or that any article or clause contained in this User Agreement is no longer valid, such matter shall not invalidate the validity of the remaining articles, clauses and terms contained in this User Agreement and shall remain in force until further notice from Breath Store Management.
This User Agreement - which may be amended from time to time as necessary - constitutes the User Agreement, operating mechanism, understanding, agreement, and contract between Breath Store and the user. Both parties to this agreement agree that the following shall be taken into consideration:
1. Arabic shall be the language used when interpreting the provisions of this Agreement, or when translating it into another language.
2. All prices displayed for Breath Store services or products may be modified from time to time.
3. The promotional or marketing offers that Breath Store may put forward are temporary offers, as Breath Store has the right to modify or discontinue these promotional or marketing offers at any time.
4. Breath Store has the right to issue or discontinue promotional codes at any time as needed.
5. The parties to this agreement undertake to deal with each other in a manner that does not violate the Sharia rules, regulations and laws in force related to the nature of the transaction between Breath Store and the user.
6. This User Agreement shall only be cancelled by a decision issued by the Breath Store Management.
